Pennsylvania Right-To-Know
 
Former Governor Edward G. Rendell signed the Right-To-Know Law on February 14, 2008, fundamentally changing the way people access public records of their government.  The hallmark of this law, which fully took effect in January 1, 2009, is its presumption of openness.  For the first time in Pennsylvania history, citizens no longer have to prove that a record is public and that is should be released.  Now, a government agency must presume that a record is a public record available for inspection or copying.  If the government agency chooses to withhold a record, the agency has the burden to prove -- with legal citation -- why that record should not be available to the public.

The Right-To-Know Law requires the Office of Open Records to create a Uniform Request Form that must be accepted by all Commonwealth Agencies.  To request information under the Right-To-Know Law from Westmoreland Intermediate Unit, please download the attached Right-To-Know Request Form.

The Right-To-Know Law requires that each government agency appoint a RTK (Right-To-Know) Officer.  The RTK Officer will be the assigned person to receive Right-To-Know requests submitted to the Westmoreland Intermediate Unit; direct requests to the appropriate persons within the IU or to the appropriate person in another agency; track the IU's progress in responding to requests; and to issue interim  and final responses under the act.
